Switch Hit – End‑User Licence Agreement & Terms of Use

1. Introduction & Acceptance
Welcome to Switch Hit (the “App”), provided by Switch Hit Pty Ltd, an Australian company (ABN 12 345 678 910). By using the App, you agree to these Terms of Use. If you do not agree, please do not use the App. This agreement incorporates Apple’s Standard EULA.
2. Eligibility
You must be at least 13 years old to create an account. Users under 18 must have consent from a parent or legal guardian.
3. Licence
We grant you a personal, non-exclusive, revocable licence to use the App on Apple devices for personal, non-commercial use.
3.1 Restrictions
- No reverse-engineering or copying the App.
- No misuse or illegal use of the App.
4. Account & Security
Provide accurate details and safeguard your login credentials. You're responsible for all activity under your account.
5. Subscriptions, Trials & Billing
- Free Trial: One 7-day trial per Apple ID.
- Auto-Renewal: Renewed automatically unless cancelled 24 hours before the end of the period.
- Manage Subscriptions: Via your Apple ID settings.
- Refunds: Through Apple at reportaproblem.apple.com.
6. Parental Consent
Parental consent is required for users under 13. Parents can request data deletion by contacting us at support@switchhit6.com.
7. User-Generated Content
You own your content but grant us the right to use it for operating and improving the App.
8. Health Disclaimer
Always consult a professional before beginning any training. Use the App at your own risk.
9. Third-Party Services
We use third-party services like Firebase, AdMob, and OpenAI. Their policies apply where relevant.
10. Support

11. Apple Terms
- Apple is not responsible for the App.
- We are responsible for all product claims and support.
12. IP Ownership
All rights to the App content and code remain with us and our licensors.
13. Indemnity
You agree to indemnify us against any misuse or breach of these terms.
14. No Warranties
The App is provided “as is” without guarantees of performance or accuracy.
15. Limitation of Liability
Our liability is limited to AUD 100 or the amount you paid in the last 12 months, whichever is greater.
16. Termination
We may suspend or terminate your account for violating these terms.
17. Governing Law
These terms are governed by the laws of New South Wales, Australia.
18. Force Majeure
We are not liable for delays caused by events beyond our control.
19. Updates to Terms
We may update these terms with notice. Continued use means acceptance.
